Terms of Service
These website terms describe the current service. If an order form or negotiated agreement conflicts with these terms, the signed agreement controls.
1. The service
Book Well LLC ("Book Well") provides managed reception, inquiry intake, communications, workflow, and optional booking capabilities for business clients. The exact plan, locations, usage, implementation, term, fees, and support commitments are stated in the client's order form.
2. Authorized accounts
Accounts are invite-only. A client must keep account and business information accurate, protect credentials, use multi-factor authentication when required, and promptly report suspected unauthorized access. Client users may access only the workspace to which Book Well assigned them. Client customers and website visitors are not authorized software users.
3. Client responsibilities
The client controls its service rules, service area, eligibility criteria, calendars, customer relationships, and legal notices. The client must obtain required permissions for communications and call recording, provide accurate instructions, monitor appointment and escalation results, and avoid submitting unlawful, highly sensitive, or unnecessary data. Book Well does not provide legal, medical, emergency, or financial advice.
4. Automated systems
The service may use AI-assisted speech recognition, language processing, summaries, and synthetic voice. Automated output may be incomplete or inaccurate. Book Well uses approved scripts, eligibility controls, and human handoff paths, but the client remains responsible for reviewing consequential customer, pricing, safety, and scheduling decisions. The service must not be presented as an emergency channel.
5. Acceptable use
A user may not bypass access controls or quotas; probe another client's data; upload malware; interfere with the service; send unlawful, deceptive, or abusive communications; violate privacy, intellectual-property, telecommunications, or consumer-protection law; resell access without permission; or use the service to train or benchmark a competing system without consent.
6. Fees, billing, and cancellation
Stripe processes payments. Fees, setup charges, billing cadence, taxes, renewal, cancellation, and refund terms appear in the order form and checkout presented before purchase. Unless an order form says otherwise, month-to-month service may be canceled for the end of the current paid period by contacting support@getbookwell.com. Annual terms and notice periods are governed by the signed order form. Nonpayment may suspend operations without preventing an authorized owner from requesting data export or disconnecting integrations.
7. Client data and privacy
As between the parties, the client retains its rights in client-provided content and customer data. The client authorizes Book Well to process that data to provide, secure, support, and improve the contracted service. Our Privacy Notice and any signed data processing addendum describe that processing in more detail.
8. Third-party services
The service interoperates with providers such as Stripe, Telnyx, Cal.com, Supabase, and email or hosting providers. Their availability and terms can affect the service. Book Well will use reasonable care configuring integrations but is not responsible for a provider outage or a client's unauthorized change to a provider account.
9. Intellectual property and feedback
Book Well and its licensors retain rights in the software, workflows, documentation, branding, and service technology. A client receives a limited, non-transferable right to use the service during its paid term. Voluntary feedback may be used without restriction or identification.
10. Suspension and termination
Book Well may suspend access to protect clients or the service, address legal or security risk, stop abuse, or respond to nonpayment. On termination, ordinary processing stops, integrations are disconnected, and data enters the documented export, retention, and deletion process. Terms that by their nature should survive will survive.
11. Warranties, liability, and disputes
Service warranties, service levels, disclaimers, liability limits, indemnities, governing law, and dispute procedures must be stated in the applicable signed agreement.
